Registrar a marca
A marca deve ser registrada para garantir seu uso no futuro sem nenhum tipo de problema. O INPI - Instituto Nacional de Propriedade Industrial é responsável pelo registro aqui no Brasil, quem a registrou gozará do direito de uso EXCLUSIVO. Assim, pode-se evitar que terceiros a utilizem sem a autorização do titular.Em muitos países, a simples utilização da marca não gerará nenhuma espécie de direito para seu usuário. Por esse motivo, ele deverá registrar a marca para poder reivindicar o direito de exclusividade.
Para o registro de marca, o interessado pagará uma taxa inicial de R$197,00 correspondente ao depósito do pedido. Não havendo obstáculos processuais (exigência, oposição, etc), deverá ser paga ao final do exame a taxa referente à proteção do primeiro decênio no valor de R$329,00, além de R$75,00 pela expedição do certificado de registro. Para microempresa e pessoa física, os valores para depósito e primeiro decênio da marca são reduzidos em 50%.

É um processo meio cansativo, chato, por isso existe empresas especializada em registro de marcas. Imagine que a marca da sua empresa ou do seu cliente quer expandir para os paises do mercosul e você precisa registrar sua marca no Paraguai, Argentina, Uruguai, etc. Assim ia perder muito tempo correndo atrás das papeladas para registrar a marca em todos esses paises. Se aqui já é meio complicado, imagine em outra língua.
Se você mesmo fizer isso para sua empresa pode economizar um pouco. E se estiver fazendo um trabalho de construção de marca para alguém pode oferecer um serviço a mais.
Bem, ai vai depender de você, para decidir se deseja contratar uma empresa ou fazer por conta própria. Ou até mesmo não registrar se a empresa for muito pequena.
